Terms of Service

1. Acceptance of Terms

By accessing and using CryptoDashboardPlus ("Service", "Platform", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service ("Terms") constitute a legally binding agreement between you and Christian Luppi, the operator of CryptoDashboardPlus.

2. Description of Service

CryptoDashboardPlus is a cryptocurrency portfolio tracking and analytics platform that provides:

• Real-time price tracking: Cryptocurrency prices from CoinGecko API (market cap, volume, 24h change)
• Portfolio management: Manual trade entry, CSV import, performance analytics, profit/loss tracking
• Exchange integrations: Read-only API sync with:
  • Binance (spot trading accounts)
  • Coinbase (standard and Pro accounts)
  • Pionex (trading bot portfolios)
• Wallet tracking: Monitor blockchain wallets on Ethereum, Binance Smart Chain, Polygon, Arbitrum, Optimism, and Avalanche
• Price alerts: Configurable price notifications via email and Telegram
• Tax reports: IRS Form 8949 export for capital gains/losses (U.S. tax reporting, informational only)
• Advanced analytics: Performance charts, allocation breakdowns, historical balance tracking, ROI calculations
• Goal tracking: Set financial goals and monitor progress toward targets
• Export features: CSV export of trades, holdings, and tax reports
• Profile manager: User profile customization, theme preferences, notification settings

3. User Accounts and Registration

3.1 Account Creation

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

4. API Keys and Third-Party Integrations

4.1 Exchange API Keys (CRITICAL SECURITY REQUIREMENTS)

When you provide API keys from cryptocurrency exchanges:

• MUST BE READ-ONLY: You MUST ONLY provide API keys with read-only permissions. NEVER enable withdrawal, trading, or transfer permissions.
• Permissions required:
  • Binance: "Enable Reading" only (no "Enable Spot & Margin Trading" or "Enable Withdrawals")
  • Coinbase: "wallet:accounts:read", "wallet:transactions:read" only
  • Pionex: View-only API key (no trading or withdrawal permissions)
• Encryption: API keys and secrets are encrypted with AES-256 before storage
• Your control: You retain full ownership and can revoke API keys at any time from your exchange
• Your responsibility: You are responsible for:
  • Ensuring API keys have correct (read-only) permissions
  • Monitoring API key usage on your exchange
  • Revoking keys if you suspect compromise
  • Not sharing API keys with anyone else
• Our commitment: We will NEVER request withdrawal or trading permissions. If anyone asks for such permissions claiming to be from CryptoDashboardPlus, it is a scam.

4.2 Third-Party Services

Our Service integrates with third-party services including but not limited to:

• CoinGecko API for price data
• Binance API
• Coinbase API
• Pionex API

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or reliability of third-party services.

5. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Violate or infringe upon the rights of others
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without written permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove or modify any copyright or proprietary notices
• Use the Service to transmit malware or malicious code
• Impersonate any person or entity
• Collect or harvest personal information from other users

6. Financial Disclaimer

6.1 No Financial Advice

CryptoDashboardPlus is a portfolio tracking and analytics tool ONLY. We do not provide:

• Investment advice
• Financial planning services
• Tax advice
• Legal advice
• Trading recommendations

6.2 Risk Acknowledgment

You acknowledge and agree that:

• Cryptocurrency investments are highly speculative and volatile
• You may lose some or all of your invested capital
• Past performance does not guarantee future results
• You are solely responsible for your investment decisions
• You should consult with qualified financial advisors before making investment decisions

6.3 Data Accuracy

While we strive to provide accurate information:

• Price data may be delayed or inaccurate
• Portfolio calculations may contain errors
• Third-party API data may be unavailable or incorrect
• You should verify all information independently

7. Intellectual Property Rights

7.1 Our Property

The Service and its original content, features, and functionality are owned by Christian Luppi and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Data

You retain all rights to your portfolio data, transaction history, and personal information. By using the Service, you grant us a limited license to:

• Store and process your data to provide the Service
• Use aggregated, anonymized data for analytics and improvements
• Display your data within the Service interface

8. Subscription and Payments

8.1 Free and Premium Features

CryptoDashboardPlus offers both free and premium subscription tiers. Premium features may include:

• Advanced analytics and reporting
• Unlimited exchange connections
• Priority support
• Additional data retention
• Advanced charting features

8.2 Payment Terms

If you subscribe to premium features:

• Payment processor: Payments are processed by Stripe (we do NOT store your credit card details)
• Billing: Subscriptions are billed in advance on a recurring basis:
  • Monthly plan: Billed monthly on the same day each month
  • Annual plan: Billed annually with discounted rate
• Authorization: You authorize us to charge your payment method for all subscription fees
• Failed payments: If payment fails, we will:
  • Retry the charge up to 3 times over 7 days
  • Send email notifications about payment failure
  • Downgrade your account to free tier if payment cannot be collected
• Price changes: We may change pricing with 30 days' advance notice via email
• Currency: All prices are in USD unless otherwise specified

8.3 Refund Policy

Due to the nature of digital services:

• No refunds: All sales are final and non-refundable except where required by law
• Cancellation: You may cancel your subscription at any time to prevent future charges:
  • Go to Settings > Subscription > Cancel Subscription
  • Or manage your subscription in the Stripe billing portal
• Pro-rated refunds: We do NOT provide pro-rated refunds for partial billing periods
• Access after cancellation: You retain premium access until the end of your current billing period
• Exceptions: Refunds may be issued at our sole discretion in cases of:
  • Service outages lasting more than 7 consecutive days
  • Billing errors or duplicate charges
  • Legal requirements in your jurisdiction

9. Data Privacy and Security

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER
• WE ARE NOT RESPONSIBLE FOR:
  • Investment losses or trading decisions based on information from the Service
  • Price data inaccuracies or delays from CoinGecko or other third-party APIs
  • Exchange API failures, rate limits, or changes (Binance, Coinbase, Pionex)
  • Blockchain RPC failures or network congestion
  • Lost or compromised API keys (your responsibility to keep secure)
  • Incorrect tax calculations or reports (consult a tax professional)
  • Data synchronization errors or missing transactions
  • Service outages due to third-party dependencies

11. Indemnification

You agree to indemnify, defend, and hold harmless CryptoDashboardPlus, Christian Luppi, and our affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your investment decisions

12. Termination

12.1 Termination by You

You may stop using the Service and delete your account at any time.

12.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• Your use poses a security risk
• You engage in fraudulent activity
• Required by law

12.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account and data after 30 days
• Provisions that should survive termination will remain in effect

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will:

• Notify users of material changes via email or in-app notification
• Update the "Last Updated" date at the top of this page
• Provide at least 30 days' notice for material changes

Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

1. Good faith negotiation between the parties

3. Binding arbitration or litigation in Italian courts

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and CryptoDashboardPlus.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights without restriction.

15.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or internet failures.
